The Alberta Energy Regulator will hold a hearing of Applications No. 1739837, 1739838, 1739882, 1739884, 1751089, and 1753756. The AER will provide further information on the hearing process and any additional process after the submissions have been filed by the parties and reviewed by the regulator.

If the AER does not receive any submissions from the intervener or the intervener withdraws from the proceeding, the hearing may be cancelled and the AER will continue to process and may approve the applications without a hearing.

Description of the Applications
The pipelines and compressor station proposed in the following applications would be located about 4.95 kilometres west of Wembley.

Application No. 1739837
Encana Corporation (Encana) applied under part 4 of the Pipeline Act for approval to construct and operate a pipeline to transport fuel gas with no hydrogen sulphide (H2S) from a pipeline at Legal Subdivision (LSD) 14, Section 30, Township 71, Range 8, West of the 6th Meridian, to a proposed compressor station at LSD 16-34-70-9W6M. The proposed pipeline would be about 11.64 km long with a maximum outside diameter of 114.3 millimetres (mm).

Encana applied under part 4 of the Pipeline Act for approval to construct and operate a pipeline to transport condensate with a maximum H2S concentration of 80 moles per kilomole (mol/kmol) (8.0 per cent) from a proposed compressor station at LSD 16-34-70-9W6M to a pipeline tie-in point at LSD 14-30-71-8W6M. The proposed pipeline would be about 11.64 km long with a maximum outside diameter of 168.3 mm.

Encana applied under part 4 of the Pipeline Act for approval of a licence amendment to construct a line split.

The current pipeline is transporting sour natural gas from a well at LSD 1-34-70-9W6M to a pipeline tie-in at LSD 5-2-71-9W6M. The two amended pipelines would transport sour natural gas with a maximum H2S concentration of 100 mol/kmol (10.0 per cent) and would be operated as Level 1 pipelines.

Encana applied under part 4 of the Pipeline Act for approval of a licence amendment to change the substance and facility code on an existing pipeline. The current pipeline is transporting sour natural gas with a maximum H2S concentration of 100 mol/kmol (10.0 per cent) and would be amended to transport sour natural gas with a maximum H2S concentration of 80 mol/kmol (8.0 per cent). The pipeline is 1.80 km in length from an existing well at LSD 1-34-70-9W6M to the proposed compressor station at LSD 16-34-70-9W6M. The pipeline has a maximum outside diameter of 168.3 mm and would continue to operate as a Level 1 pipeline.

Application No. 1751089
Encana applied under section 7.001 of the Oil and Gas Conservation Regulations requesting approval to construct and operate a 7296 kilowatt gas compressor station in LSD 16-34-70-9W6M in the Elmworth Field. The compressor station would consist of one line heater, two sand separators, two inlet separator skids with liquid pumping station, four natural gas–driven compressors, one motor control centre building, one instrument air compressor, one methanol tank, one corrosion inhibitor storage tank, one flare knockout drum, and one flare stack. The facility would be licensed for a maximum H2S content of 80 mol/kmol (8.0 per cent).

Encana applied under part 4 of the Pipeline Act for approval to construct and operate the following four pipelines:

Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed in a proceeding be placed on the public record. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.

Questions of Constitutional Law
In addition to giving notice according to section 12 of the Administrative Procedures and Jurisdiction Act and schedule 2 of the Designation of Constitutional Decision Makers Regulation, you must include the following information in your submission and file it according to the dates listed under How to File a Submission if you intend to raise a question of constitutional law:
a) the constitutional question you intend to raise
b) the legal argument you intend to make
c) the evidence you intend to rely on in support of your legal argument

Under section 21 of the Responsible Energy Development Act, the AER does not have jurisdiction to assess the adequacy of Crown consultation associated with the rights of aboriginal peoples as recognized and affirmed under the Constitution Act.

Submissions relating exclusively to compensation for land use are not dealt with by the AER and should be referred to the Alberta Surface Rights Board.
