Application Submission Requirements and Guidance for Reclamation Certificates for Well Sites and Associated Facilities

This bulletin announces the release of Specified Enactment Direction 002: Application Submission Requirements and Guidance for Reclamation Certificates for Well Sites and Associated Facilities (SED 002), which is in effect as of June 21, 2016.

SED 002 has been issued by the Alberta Energy Regulator (AER) under section 137 of the Environment Protection and Enhancement Act (EPEA) and section 12(1) of the Conservation and Reclamation Regulation (CRR). SED 002 sets out the information requirements for submitting a reclamation certificate application and replaces and supersedes the Government of Alberta 2010 Reclamation Criteria for Wellsites and Associated Facilities: Applications Guidelines.

The information requirements for reclamation certificate applications that were in the 2010 guidelines have not changed. However, as announced in Bulletin 2016-17, the AER has enhanced the application submission process through an on-line tool, available on the AER website under Systems & Tools > Reclamation Certificate Application Tool. SED 002 aligns the information requirements with the AER’s on-line submission process. It also provides guidance on how to prepare a complete application for a reclamation certificate.

The AER is responsible for regulating reclamation in respect of energy resource activities in accordance with EPEA. Under EPEA, an operator is required to conserve and reclaim specified land and obtain a reclamation certificate. A reclamation certificate is issued to an operator when its site has been successfully reclaimed.

Section 137 of EPEA outlines an operator’s duty to conserve and reclaim specified land and to obtain a reclamation certificate.

Section 138 of EPEA outlines that an application for a reclamation certificate must be made to the AER in the form and manner and within the time provided for in the regulations. Section 12(1) of the CRR outlines what the reclamation certificate application must contain. 

SED 002 supports the AER’s environmental mandate as a full life-cycle regulator, regulating application and construction through to abandonment and reclamation. SED 002 will ensure that lands used for oil and gas activities continue to be restored to an equivalent land capability and will bring greater regulatory efficiency through operators’ use of the on-line tool. The AER will continue to conduct environmental audits to ensure regulatory compliance.
