The Alberta Energy Regulator (AER) will hold a prehearing meeting for the regulatory appeal of the amendments to Environmental Protection and Enhancement Act (EPEA) approval 73534-01-02 and Oil Sands Conservation Act (OSCA) approval 8558MM for Imperial Oil Resources Limited’s (Imperial’s) Cold Lake expansion project at Govier Hall, 3rd floor, 250 – 5th Street S.W., Calgary, Alberta, on August 13, 2019, starting at 9:00 a.m. The hearing will be webcast at www.meetview.com/aer.
The AER issued a notice of hearing on April 1, 2019, announcing a public hearing on the regulatory appeal. The AER issued its decisions about participation for the regulatory appeal hearing on July 9, 2019. The participants are the City of Cold Lake, the MD of Bonnyville, Fishing Lake Métis Settlement, Buffalo Lake Métis Settlement, and Kehewin Cree Nation. Also participating in the hearing are Elizabeth Métis Settlement (the party that was granted the regulatory appeal), Imperial (the holder of the amended approvals), and the AER Authorizations Group (the decision maker on the approval amendments). The hearing will be scheduled at a later date.
What is the purpose of the meeting?
The purpose of the prehearing meeting, as outlined in the AER’s July 11, 2019, letter to the parties, is to establish the steps of the hearing process and hear submissions on (1) the scope of the AER Authorizations Group’s participation in the hearing and (2) the standard of review applicable to this regulatory appeal. The prehearing meeting will be open to the public to observe. Participation in the prehearing meeting is limited to the above parties.
Evidence or argument on the merits of the regulatory appeal or statements of concern will not be discussed at the prehearing meeting.
