Section 8.0 Application Submission: Landowner Contact
Effective immediately, the Alberta Energy Regulator (AER) has implemented changes in the landowner contact requirements of the 2010 Reclamation Criteria for Wellsites and Associated Facilities: Application Guidelines (Guidelines) to ensure that the application process is consistent with the AER’s process under the Responsible Energy Development Act and related rules for the filing of statements of concern.
Applicants no longer need to include a copy of the “Upstream Oil and Gas Facility Complaint Form” in the application package that they provide to affected parties before they submit the application to the AER. Instead, the applicant must provide all affected parties, as described under the Guidelines, with a copy of the following documents:
- EnerFAQs “Expressing Your Concern – How to File a Statement of Concern About an Energy Resource Project”
- the form “Statement of Concern About an Energy Resource Project”
- once an application has been submitted to the AER, a copy of the public notice of application from the AER website
The remainder of the application process in the 2010 Reclamation Criteria for Wellsites and Associated Facilities: Application Guidelines continues to apply.
Once an application is received by the AER, a person who believes they may be directly and adversely affected by the application may file a statement of concern with the AER. For information about how to file a statement of concern, please see the AER EnerFAQs “Expressing Your Concerns – How to file a Statement of Concern About an Energy Resource Project” and Bulletin 2014-39: Change in Business Process Relating to Reapplication Statements of Concern on the AER website.
Note that this change does not affect the ability of Albertans who are concerned about the operations of existing energy resource activities to make their concerns known by filing an operational complaint. An operational complaint can be made at any time during the life of the project, including after a reclamation certificate is issued, to the Coordination and Information Centre at 1-800-222-6514.
