New Edition of Directive 067: Eligibility Requirements for Acquiring and Holding Energy Licences and Approvals

The Alberta Energy Regulator (AER) announces the release of a new edition of Directive 067: Eligibility Requirements for Acquiring and Holding Energy Licences and Approvals.

Acquiring and holding a licence or approval in Alberta is a privilege, not a right. This new edition of the directive increases the scrutiny the AER applies to ensure that this privilege is only granted to, and retained by, responsible parties.

Changes include requiring additional information at the time of application, increased discretion regarding the rejection of applications where an applicant poses a risk, and requirements for keeping corporate information up to date.

Licence eligibility types have been simplified to the following three types: no eligibility, general eligibility, and limited eligibility. The following licence eligibility types will be converted to “limited eligibility”:

  • well, facility or pipeline (all types) that was granted with conditions,
  • public educational institution,
  • government,
  • water wells drilled deeper than 150m,
  • farm gas well licence and gas well licensed for domestic use (and associated pipeline licence), and
  • mineral exploration test hole licences.

All parties with current Directive 067 eligibility are required to ensure that the AER has accurate information on file. Under the directive, notice of material changes must be provided within 30 days. Existing licensees with eligibility as of today’s date have until January 31, 2018, to provide an updated schedule 1. Failure to provide the updated schedule may result in the AER either revoking or restricting licence eligibility.
