NOTE: The initial notice of hearing was issued on August 12, 2020 and an amended notice hearing was issued on September 1, 2020. This notice provides new deadlines for confirmation of participation, filing a request to participate and responses from the applicants regarding requests to participate.

The Alberta Energy Regulator (AER) will hold a public hearing of applications 1925343 and 1925602 (the applications). This notice sets out how to request to participate in the hearing. The hearing will be scheduled later or, if there are no participants, the AER may cancel the hearing and decide on the applications without further notice.

Description of the Applications

Enerplus Corporation (Enerplus) and Robus Resources Inc. (Robus) applied under section 24 of the Oil and Gas Conservation Act for approval to transfer licences for 108 wells, 7 facilities and 30 pipelines from Enerplus to Robus. The wells, facilities and pipelines are located in the Joarcam field approximately 36 kilometres northwest of Camrose, Alberta, in Township 47 Range 20, Township 48 Range 20, Township 49 Range 21, Township 50 Ranges 20 – 22, West of the 4th Meridian. How can I apply to participate in the hearing?

As the applicants, Enerplus and Robus do not have to apply to participate in the hearing.

If you are an Indian Reserve, Metis settlement or municipal authority that has filed a statement of concern in respect of the applications and otherwise meets the requirements of section 3.2(2) of the Responsible Energy Development Act General Regulation, you may participate in the hearing and do not need to submit a request to participate. However, you must confirm your intention to participate in the hearing and the nature and scope of your participation to the hearing coordinator no later than noon on November 16, 2020.

All other persons who wish to participate in the hearing must submit a written request to participate, even if you have already filed a statement of concern with the AER in respect of the applications. Your request to participate must contain the following information:

  1. a copy of your statement of concern or an explanation why you did not file one;
  2. a concise statement indicating
    1. why and how you may be directly and adversely affected by the AER’s decision on the applications, or
    2. if you will not be directly and adversely affected by a decision on the applications, explain
      • what the nature of your interest in the matter is and why you should be permitted to participate,
      • how your participation will materially assist the AER in deciding the matter that is the subject of the hearing,
      • how you have a tangible interest in the subject matter of the hearing,
      • how your participation will not unnecessarily delay the hearing, and
      • how you will not repeat or duplicate evidence presented by other parties;
  3. the outcome of the applications that you advocate;
  4. the nature and scope of your intended participation;
  5. your contact information;
  6. if you are acting on behalf of a group or association of people, the nature of your membership in the group or association; and
  7. your efforts, if any, to resolve issues associated with the proceeding directly with the applicants.

Send one copy of the request to Enerplus, one copy to Robus and one copy to the hearing coordinators. Submissions should be PDF documents with bookmarks, page numbers (with the first page in the document being numbered page one), and optical character recognition.

Filing deadlines

You must submit your request by 4:00 p.m. on the filing date below.

November 16, 2020Final date to file a request to participate.
November 30, 2020Final date for response from the applicants on any requests to participate.

Is this a public process?

Yes. Section 49 of the Alberta Energy Regulator Rules of Practice (Rules of Practice) requires that all documents and information filed for a proceeding, including requests to participate, be placed on the public record. You must not include any personal information that you do not want to appear on or are not authorized to put on the public record. You should assume that anything you submit will be available online to the public. Section 49(2) of the Rules of Practice states how to apply to the AER for an order to keep information confidential.

If my request to participate is approved, can I apply to get reimbursed for hearing-related costs?

If you are participating in a hearing, you may be eligible to have some of your costs paid. Directive 031: REDA Energy Cost Claims explains how and when to apply.

What is outside of the AER’s jurisdiction?
Compensation for land use is not dealt with by the AER and should be referred to the Alberta Surface Rights Board.
