Request for Regulatory Appeal

Anyone requesting an appeal must follow the timelines shown in the table below. For more information, see, our appeal process webpage.

Every decision we issue is governed by provincial legislation. We decide on approvals for licences, leases, authorizations, and certificates. The following table lists

the type of decisions can be appealed,
who is eligible to file a request for an appeal, and
the deadline to make the request.

Enforcement or environmental protection order issued under the Environmental Protection and Enhancement Act	Any eligible person*	Depending on the authority exercised, 7 or 30 calendar days from the issue date of the enforcement or environmental protection order
Reclamation certificates issued under the Environmental Protection and Enhancement Act	Any eligible person*	1 year after the reclamation certificate is issued
Gas Resources Preservation Act
Approvals issued under the Gas Resources Preservation Act	Any eligible person*	30 calendar days after the notice of decision is issued
Oil and Gas Conservation Act
Approvals issued under the Oil and Gas Conservation Act	Any eligible person*	30 calendar days after the notice of decision is issued
Orders issued under the Oil and Gas Conservation Act, including the following: suspend or abandon a well or facility payment of costs: suspension, abandonment, remediation, or reclamation shut down or close a well or facility	Any eligible person*	7 calendar days after the notice of order is issued
Oil Sands Conservation Act
Approvals issued under the Oil Sands Conservation Act	Any eligible person*	30 calendar days after the notice of decision is issued

Pipeline Act

Public Lands Act
Approvals issued under the Public Lands Act	Any eligible person*	30 calendar days after the notice of decision is issued
Enforcement orders issued under the Public Lands Act for contravention of a provision of an Alberta Land Stewardship Act regional plan, a provision of the Public Lands Act	Any eligible person*	7 calendar days from the date the enforcement order was issued
Orders issued under the Public Lands Administration Regulation	Any eligible person*	7 calendar days after the notice of order is issued
Orders to stop an activity or land use on public land; demolish, remove, or replace improvements made or in the process of being made, carry out any other actions required so that the activity or land use on public land complies with the Public Lands Act	Any eligible person*	No later than 3 hours after the order is issued
Removal of a thing, without warrant or order under the Public Lands Act, that in the opinion of an officer is causing or may cause loss or damage to land or any other thing on the land	Any eligible person*	No later than 3 hours after the thing is removed
Responsible Energy Development Act
Administrative penalties imposed under the Responsible Energy Development Act	Any person required to pay an administrative penalty	30 calendar days after the notice of administrative penalty is issued
Water Act

Issuance or refusal of an approval to commence or continue an activity under the Water Act	Any eligible person*	7 calendar days after the notice of order is issued
Water management or enforcement order issued under the Water Act	Any eligible person*	7 calendar days from the date the enforcement order is issued
Other
Any other appealable decision under the energy resource enactments or specified enactments	Any eligible person*	30 calendar days after the notice of decision is issued

* An eligible person is

any person who is directly and adversely affected by a decision of the AER under an energy resource enactment,
any person who is permitted under the specified enactments to file a notice of appeal under those enactments, or
any other person described in the regulation
