NOTE: The initial notice of hearing for the hearing of Shell's transfer applications for its Foothills assets was issued on July 5, 2021. Inadvertently, one of the maps did not reflect all the project areas. This notice clarifies the description of the applications and provides corrected maps. As a result, the initial July 27, 2021, deadline to file a request to participate has been extended to August 3, 2021. The deadline for filing a response from the applicants on any requests to participate has also been extended to August 17, 2021. Please note that this Amended Notice of Hearing replaces the initial notice issued on July 5, 2021.

The Alberta Energy Regulator (AER) will hold a public hearing for transfer applications, as set out in the table below, from Shell Canada Limited (Shell) to Pieridae Alberta Production Ltd. (Pieridae). This notice sets out how to request to participate in the hearing. The hearing will be scheduled later or, if there are no participants, the AER may cancel the hearing and decide on the applications without further notice to the public.

Description of the Applications
Shell has applied to transfer all the licences and approvals for its Waterton, Caroline, and Jumping Pound assets (collectively, the Foothills assets), to Pieridae. The Foothills assets are divided into three main operating areas named; Caroline, Jumping Pound, and Waterton, and include 282 well licences, 70 facility licences (including 3 gas plants), 81 pipeline licences, and other associated approvals and licences located in the southern Alberta Foothills. How can I apply to participate in the hearing?
As the applicants, Shell and Pieridae do not have to apply to participate in the hearing. However, they must confirm their intention to participate in the hearing, and the nature and scope of that participation, to the hearing coordinators by 4:00 pm MST on August 3, 2021.

All other persons who wish to participate in the hearing must submit a written request to participate, even if you have already filed a statement of concern with the AER in respect of the applications. Requests to participate are placed on the public record of this proceeding.

Your request to participate must contain the following information:

  1. a copy of your statement of concern or an explanation why you did not file one;
  2. a concise statement indicating
    1. why and how you may be directly and adversely affected by the AER's decision on the applications, or
    2. if you will not be directly and adversely affected by a decision on the applications, explain
      • what the nature of your interest in the matter is and why you should be permitted to participate,
      • how your participation will materially assist the AER in deciding the matter that is the subject of the hearing,
      • how you have a tangible interest in the subject matter of the hearing,
      • how your participation will not unnecessarily delay the hearing, and
      • how you will not repeat or duplicate evidence presented by other parties;
  3. the outcome of the applications that you advocate;
  4. the nature and scope of your intended participation;
  5. your contact information;
  6. if you are acting on behalf of a group or association of people, the nature of your membership in the group or association; and
  7. your efforts, if any, to resolve issues associated with the proceeding directly with the applicants.

Send copies of the request to participate to Shell, Pieridae, and the hearing coordinators. Submissions should be PDF documents with bookmarks, page numbers (with the first page in the document being numbered page one), and optical character recognition.

Is this a public process?
Yes. Section 49 of the Alberta Energy Regulator Rules of Practice (Rules) requires that all documents and information filed in respect of a proceeding be placed on the public record. You must not include any personal information that you do not want to appear, or you are not authorized to place, on the public record. You should assume that anything you submit will be available online to the public. Section 49(2) of the Rules states how to apply to the AER for an order to keep information confidential.

If my request to participate is approved, can I apply to get reimbursed for hearing-related costs?
If you are participating in a hearing, you may be eligible to have some of your costs reimbursed. Directive 031: REDA Energy Cost Claims explains how and when to apply.

What is outside of the AER's jurisdiction?
Compensation for land use is not dealt with by the AER and should be referred to the Alberta Surface Rights Board.

Crown consultation with Alberta's First Nations and Métis settlements and assessment of its adequacy are managed by the Aboriginal Consultation Office.
